The Government issued Decree 151/2025/ND-CP regulating the division of authority of local authorities at two levels, decentralization and delegation in the land sector.
In particular, regarding the transitional provisions, the Decree clearly states that in cases where applications for land allocation, land lease, and change of land use purpose have been submitted before July 1, 2025 but have not been resolved by competent authorities, the following shall be implemented:
In cases under the authority of the Provincial People's Committee according to the provisions of law before July 1, 2025, the Chairman of the Provincial People's Committee shall now resolve them according to the procedures prescribed by the land law before the effective date of this Decree.
In cases under the authority of the District People's Committee as prescribed by law before July 1, 2025, the Chairman of the Commune People's Committee shall now resolve them according to the procedures prescribed in this Decree.
Land lease contracts signed before July 1, 2025 will continue to be valid until the end of the term stated in the contract.
Land registration dossiers, properties attached to land, issuance of Certificates of land use rights, ownership of properties attached to land that have been received before July 1, 2025 but have not been resolved by competent authorities shall be implemented as follows:
In cases under the authority of the Provincial People's Committee according to the provisions of law before July 1, 2025, they shall now be resolved according to the procedures prescribed by the land law before the effective date of this Decree.
In cases under the authority of the District People's Committee as prescribed by law before July 1, 2025, the Chairman of the Commune People's Committee shall now resolve them according to the procedures prescribed in this Decree.
In the case of localities that are developing land price lists to be announced and applied from January 1, 2026, and now implementing the 2-level local government model, the Provincial People's Committee of the new administrative unit shall continue to perform the task of developing land price lists to promptly announce and apply from January 1, 2026 in accordance with the law.
Regarding procedures and records for land registration, assets attached to land, and cadastral records, the Government requires that agencies handling administrative procedures on land not require land users to correct records and documents related to land after the arrangement and organization of two-level local governments, but to do so simultaneously when land users carry out administrative procedures or based on the needs of land users.
The People's Committee at the commune level is responsible for publicly announcing the commune-level land use planning at the agency's headquarters and on the electronic information portal of the People's Committee at the commune level.
The resolution on the arrangement of provincial-level administrative units in 2025 was passed by the National Assembly on the morning of June 12, resolving to reduce the number of provinces and cities nationwide from 63 to 34.
Thus, after the arrangement, the whole country has 34 provinces and cities and 3,321 communes, wards and special zones.
According to the Government's plan, from June 30, all localities will simultaneously announce new administrative boundaries of provinces and communes, along with new leadership apparatus. From July 1, the new apparatus following the two-level local government model will officially operate.
