Many changes related to the establishment and approval of urban and rural planning

Unfinished urban and rural plans prepared by the district level will be transferred to the provincial or communal level. Zoning plans can continue to be used for up to 2 years after the new law takes effect (expected on January 1, 2026).

The draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning (draft) is being appraised by the Ministry of Justice , focusing on organizing two-level local governments; strong decentralization, cutting down procedures, helping people and businesses access planning procedures faster, with fewer levels, and lower costs...

Specifically, all regulations in the Law on Urban and Rural Planning are adjusted according to the provincial and communal level models. The tasks and powers previously belonging to the district-level People's Committee are transferred to the provincial level for important contents (general urban planning, economic zones, national tourist areas, etc.) and to the communal level for contents directly related to the community (commune planning, detailed planning, and zoning within the commune boundary).

Abolish the general planning of towns and districts (due to no district level organization). Communes oriented to become urban areas do not have commune planning but have urban planning.

Many authorities of the Prime Minister and the Ministry of Construction were transferred, in which the authority to approve general urban planning and national tourist areas (previously under the Prime Minister) was transferred to the provincial People's Committee.

The appraisal of the general planning of national tourist areas (formerly under the Ministry of Construction) is transferred to the provincial specialized department.

The authority to approve detailed planning for defense and security projects from the Prime Minister is transferred to the Ministry of National Defense and the Ministry of Public Security.

The draft eliminates the procedure for approving the overall adjustment of the zoning plan, the procedure for reporting to the People's Council, and the procedure for consulting the community at some stages.

Provincial People's Committees are proactive in issuing management regulations according to planning, without having to wait for the opinion of the Ministry of Construction.

Along with that, the time limit for planning establishment, appraisal and approval is also shortened and clearly defined.
