On the morning of June 9, the National Assembly Standing Committee gave its opinions on the reception, explanation, and revision of the draft Law on Teachers. The content related to extra teaching and learning received quite a lot of discussion.
Teachers are prohibited from forcing students to take extra classes in any form.
Presenting the report, Chairman of the Committee for Culture and Society Nguyen Dac Vinh said that there were opinions suggesting that the Government develop a set of regulations on extra teaching and learning and prohibit teachers from giving extra teaching in violation of the law; and proposing to prohibit teachers from giving extra teaching to students they are directly teaching.
Regarding this content, Mr. Vinh said the bill does not prohibit extra teaching and learning, but only stipulates that teachers are not allowed to force students to participate in extra learning in any form, in order to limit and gradually overcome the widespread situation of extra teaching and learning.
Currently, the Ministry of Education and Training has issued a circular guiding on extra teaching and learning, which clearly states that teachers are prohibited from giving extra lessons to students they are directly teaching.
Giving his opinion on the discussion, Chairman of the Delegation Work Committee Nguyen Thanh Hai said the bill stipulates prohibited acts, including forcing people to take extra classes in any form.
However, in reality, "forcing" students to attend extra classes can be distorted in many ways, causing difficulties in management.
Ms. Hai said that after the Ministry of Education and Training issued Circular 29/2024 regulating extra teaching and learning, educational institutions and localities have implemented these contents very drastically.
However, teachers can choose from three forms of tutoring, including home tutoring, tutoring at the center, and online tutoring. This has led to some teachers organizing online tutoring classes via Zoom, Google Meet, and still charging students.
In addition, the regulation "no coercion in any form" can be circumvented by forcing students or parents to voluntarily register for extra classes.
Therefore, she proposed that the bill clearly define the concept of extra teaching and learning and add the requirement that "no profiteering is allowed in extra teaching and learning".
According to Ms. Hai, such regulations will help clarify the legal framework for extra teaching and learning, helping students to study extra according to their legitimate wishes, but limit teachers from taking advantage.
She analyzed why doctors have after-hours examinations, there is no concept of "extra examination". Therefore, the concept of "extra teaching" is very specific, "learning in class is not enough or if you want to learn better, you can go outside to take extra classes, is this extra class charged or not charged". She suggested that there should be clearer regulations on extra classes.
Many students just want to listen to their teacher, they don't want to learn from another teacher.
Vice Chairman of the National Assembly Tran Quang Phuong agreed that it is necessary to ban forced tutoring in all forms.
He suggested that the drafting agency should have measures to clearly distinguish between forcing or not forcing extra classes, on the basis of respecting the right to study of students and parents.
Citing Circular 29/2024 of the Ministry of Education and Training, Mr. Tran Quang Phuong expressed his disagreement when the ministry banned teachers from giving extra lessons to their regular students.
He said, a student listening to a lecture in class can absorb 70% of the knowledge if he has good absorption ability. But some students only understand 50%, even 30-40%, and not everyone who listens to a lecture can memorize and understand the lesson.
He said the Ministry of Education and Training has a regulation prohibiting teachers from giving extra lessons to regular students to ensure strictness, but it is not suitable. Because for many students, they only want to listen to their teacher lecture, not to learn from another teacher.
"The teacher who teaches directly is the one who regularly interacts with and understands the students' level and ability. There shouldn't be too strict rules, just don't force them," he said.

Explaining later, Minister of Education and Training Nguyen Kim Son said that extra teaching and learning are only specific to the subjects clearly defined in Circular 29.
Extra teaching and learning are additional teaching and learning activities outside the time specified in the education plan for subjects and educational activities in the general education program, the continuing education program at the junior high school level, and the continuing education program at the high school level.
According to Minister Nguyen Kim Son, in the section regulating what teachers are not allowed to do in the draft law, it is stipulated that students must not be forced to participate in extra classes in any form.
This regulation, Mr. Son said, first of all reflects the views on teachers' ethics rather than being a professional regulation.
Regarding the regulation that teachers are not allowed to force students who are taught in class to take extra classes, the minister said that in their responsibility to perform their duties, teachers must complete the task of equipping their students with knowledge during regular school hours.
If during regular school hours, teachers do not complete their work, they will not fulfill their public duties.
If that person is allowed to bring home content that is part of their official duty to teach, it will lead to distortion, causing the teacher to fail to fulfill his official duty.
He added that for good and weak students preparing for graduation exams, teachers are allowed to teach their students right in school and this is clearly regulated.
"This regulation is intended to strictly implement public service responsibilities and help teachers fulfill their responsibilities," Mr. Son stated.
