The National Assembly Standing Committee gives opinions on the draft Law on Civil Aviation of Vietnam (amended)
Presenting the Report at the meeting, Minister of Construction Tran Hong Minh emphasized that the development of the Law on Civil Aviation of Vietnam (amended) aims to institutionalize the guidelines and policies of the Party and State, perfect the mechanisms and policies in the field of civil aviation; implement Vietnam's commitments to the international community; enhance the effectiveness and efficiency of State management of civil aviation; overcome difficulties and shortcomings; propose solutions to new and emerging issues; clear bottlenecks, create new momentum for socio-economic development, international integration, and ensure national defense and security in the new era - the era of national development.
This Law regulates civil aviation activities, including regulations on aircraft, airports, aviation personnel, flight operations, commercial air transport, general aviation, specialized aviation, aviation safety, aviation security, civil liability and other activities related to civil aviation.
Civil aviation activities of the armed forces and other State agencies shall be carried out in accordance with the provisions of this Law; aircraft, aircraft activities of the armed forces and other State agencies in Vietnam serving official purposes, unmanned aircraft, and other flying vehicles shall be selected to apply the entirety or specific articles, clauses, and points of this Law.
Examining the draft law, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the Standing Committee of the Committee agreed to comprehensively amend the Law on Civil Aviation of Vietnam for the reasons stated in the Government's Submission. The contents of the draft law are consistent with the Party's policies and guidelines; basically meet the requirements of innovation in law-making thinking; and ensure constitutionality.
However, the content of the draft Law is related to many current laws, the draft law submitted to the National Assembly at the 10th Session and international treaties to which Vietnam is a member. Therefore, the Committee on Law and Justice proposes to continue reviewing to ensure compatibility, consistency and uniformity; in cases where it is really necessary to have regulations different from current laws to meet the requirements of civil aviation activities, it is necessary to propose amendments to the provisions of relevant laws.
The Standing Committee of the Law and Justice Committee proposed to continue studying and reviewing the scope of the draft Law with the Law on People's Air Defense to ensure consistency, avoid duplication and overlap; and at the same time not create legal gaps.
Discussing at the meeting, members of the National Assembly Standing Committee agreed to comprehensively amend the Law on Civil Aviation of Vietnam and agreed that agencies need to coordinate closely to complete the draft Law with the highest quality; submit it to the National Assembly for consideration and approval according to the one-session process at the 10th session, while emphasizing that the amendment of the Law on Civil Aviation of Vietnam must be consistent and synchronous with the legal system, avoiding overlap with related laws.
Members of the National Assembly Standing Committee also contributed ideas on creating a mechanism to attract non-state resources and enterprises to invest in aviation business, reducing the burden on the State budget; continuing to promote administrative procedure reform, improving the business environment, creating favorable conditions for people and businesses; strengthening decentralization and delegation of power in State management of civil aviation; improving the effectiveness and quality of work to prevent and combat corruption, waste and negativity in State management of civil aviation...
Vice Chairman of the National Assembly Nguyen Khac Dinh delivered a concluding speech at the meeting.
Concluding the session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the draft Law is eligible to be submitted to the National Assembly for consideration at the 10th session; at the same time, he requested the drafting agency to advise the Government to continue reviewing and clarifying the scope of the draft law for some types of unmanned aircraft and other flying vehicles, ensuring that there is no duplication or overlap with the provisions of the Law on People's Air Defense, but also not leading to a legal gap in regulating related types of vehicles.
At the same time, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the drafting agency to coordinate with other agencies to continue researching and carefully reviewing the provisions of the draft law, ensuring compatibility with international treaties to which Vietnam is a member and ensuring the consistency of the legal system.
In addition, the drafting agency shall coordinate with relevant agencies to study, carefully review, propose revisions and complete specific regulations on the interpretation of terms; issues of management and effective socio-economic exploitation of low-altitude space, including principles on aviation infrastructure planning, investment policies for the development of aircraft production, policies on the use of light aircraft serving socio-economic sectors, rescue, national defense and security.
On the basis of fully absorbing the opinions of the National Assembly Standing Committee and the opinions of the examining agency, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the Ministry of Construction to coordinate with relevant ministries and branches to urgently advise the Government to complete the draft law dossier to send to National Assembly deputies, and at the same time send it to the Law and Justice Committee for official examination.
