On the afternoon of March 4, at a press conference organized by Lam Dong province, Mr. Le Quang Trung, Director of Lam Dong Department of Construction, said that he would grant a license to build a golf club building in Cu Da Lat Hill if the investor was allowed to change the land use purpose.

Golf club building with many violations will be granted construction permit

Mr. Trung said that the construction project of the golf club building in Cu Hill, invested by Hoang Gia DL Joint Stock Company, includes 2 construction items: Service block 1, service block 2 and reception house.

In which, service block 1 was granted license No. 02/GPXD on January 12, 2023 by the Department of Construction to build part of the basement of block 1, but during the construction process, the investor committed 2 violations including: Constructing a construction item with a part of the area (130 m2 ) on land that has not been permitted by the competent authority to change the land use purpose (from protective forest land to construction).

Second is the construction of a building that is not in accordance with the granted license. Specifically, according to the license, the basement (licensed area 2,639 m2 ) but in reality, it was 2,900 m2 ; the unlicensed area includes the illegally built ground floor of 1,933 m2 , the upper floor of 1,100 m2 . The total floor area in violation is 3,294 m2 . This act violated the provisions of Decree 16/2022/ND-CP dated January 28, 2022 of the Government .

According to Mr. Trung, the service block 2 and reception block are two construction items that have not been granted a construction permit. During the construction process, the investor committed two violations, including: Constructing construction items on a part of the land area that has not been permitted by the competent authority to change the land use purpose with an area of ​​4,499.9 m2 (service block 2 is 2,627.5 m2 and reception block is 1,872.4 m2 ). Constructing construction items without a construction permit on a part of the land area that has been changed the land use purpose.

Unlicensed construction service block

For the above violations, the People's Committee of Da Lat City has issued two decisions to fine Hoang Gia DL Joint Stock Company a total of 240 million VND. At the same time, it requested the investor to stop construction, contact the authorities, and prepare documents to apply for a construction permit according to regulations.

In case the competent authority refuses to grant a construction permit or after being granted a permit, it must demolish the entire part of the construction that is not in accordance with the approved construction permit and design. The time limit for implementing remedial measures is 90 days from the date of issuance of the decision on administrative sanctions.

The golf club building in Cu Hill, Da Lat is mostly built on protected forest land that has not been converted to another purpose.

Mr. Trung added that, for the act of constructing construction items on land areas that have not been permitted by competent authorities to change the land use purpose, the Chief Inspector of the Department of Natural Resources and Environment has imposed an administrative fine of 45 million VND on Hoang Gia DL Joint Stock Company in Decision 37/QD-XPHC dated December 15, 2023; at the same time, return the amount of illegal profits obtained from committing administrative violations in the amount of 527 million VND.

This company has complied with the fine and returned the illegal profits according to the above penalty decision. The remedial measure is to force the investor to register the land to change the land use purpose according to Document No. 5667/UBND-QH dated August 11, 2021 of Lam Dong Provincial People's Committee.

"Currently, the investor has paid the fine, the money and "The investor has 90 days to complete the procedures for converting land use purposes and applying for a construction permit. If the investor is allowed to convert the land use purpose, the Department of Construction will issue a construction permit for the golf club building," said Mr. Trung.
