Chairman of the Committee on Culture and Society Nguyen Dac Vinh reported on a number of major issues in explaining, receiving and revising the draft Law on Teachers.
Accordingly, the notable new point is that the draft Law on Teachers has clarified the subjects of regulation, including teachers working under labor contracts and cases where people with the title of teacher concurrently hold management positions; retired teachers who are currently teaching at non-publiceducational institutions. The draft law does not regulate other personnel such as school staff or guest teachers, because these subjects are regulated by the Law on Education, the Law on Vocational Education and the Law on Higher Education. Incorporating the opinions of delegates, the draft law stipulates that teachers who are university lecturers have the right to participate in the management and operation of enterprises.
Specifically, the proposal to expand this policy to vocational education teachers needs to be carefully studied. After evaluating and summarizing the implementation practices, there will be a basis for expanding the target group in the next phase. The assignment of tasks and balancing of working time for teachers participating in the management and operation of enterprises will be specified in detail in the implementation guidance document.
Regarding extra teaching and learning - the content that has received special attention from society, the draft law stipulates that it does not absolutely prohibit extra teaching and learning, but clearly stipulates that teachers are not allowed to force students to participate in extra learning in any form. Detailed regulations on teachers not being allowed to teach extra to students they are directly teaching have been issued by the Ministry of Education and Training (MOET).
Vice Chairman of the National Assembly Tran Quang Phuong noted the regulation prohibiting forcing students to participate in extra classes in any form. Accordingly, forcing extra classes can take many forms, such as forcing them to attend teacher's homes, forcing them to voluntarily apply for extra classes... From this, a student in class can absorb 70% of the knowledge learned in class, but there are also students who absorb 50% or 30-40% and not all students know their lessons after class.

Therefore, the ban on teachers giving extra classes to students who are directly teaching them needs to be re-examined... Explaining and clarifying this issue, Minister of Education and Training Nguyen Kim Son explained that the regulation "students must not be forced to take extra classes in any form" reflects the ethical viewpoint of teachers.
At the same time, the Minister explained that in the responsibility of performing public duties, teachers must complete the task of equipping students with knowledge during regular school hours. If they do not complete the task during regular school hours, it means that teachers do not fulfill their public duties...
